1. Agreement
These Terms of Service (“Terms”) govern your use of 日寫 and related services provided by Wai Lok Ching, the developer of 日寫 (“the developer”, “we”, “us”, or “our”). By creating an account or using 日寫, you agree to these Terms and our Community Guidelines and acknowledge our Privacy Policy. If you do not agree, please do not use 日寫.
2. Eligibility and Accounts
You must meet the minimum age requirements applicable to 日寫 in your country or region. You agree to provide accurate information where requested and not deliberately misrepresent your age in order to bypass safety restrictions. You are responsible for activity conducted through your account and for keeping your login credentials secure. You may not impersonate another person or create an account for fraudulent, abusive, or unlawful purposes.
3. Using 日寫
日寫 provides writing prompts, writing tools, community features, and related services. You agree to use the service in accordance with these Terms, our Community Guidelines, and applicable law.
You may not:
- Interfere with or disrupt the service;
- Attempt to gain unauthorised access to our systems or another user's account;
- Scrape or systematically extract content without permission;
- Use automated systems to spam or manipulate the service;
- Circumvent safety, moderation, access, or technical restrictions;
- Use 日寫 for unlawful, fraudulent, exploitative, or abusive purposes.
4. Your Content
You retain ownership of the original content you create and submit to 日寫. To operate the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, format, display, and distribute your content as necessary to provide, moderate, secure, and improve 日寫. This licence does not transfer ownership of your writing to us. Where functionality allows you to make content publicly available, you understand that other users may be able to view and interact with that content. If you delete content or your account, we will take reasonable steps to remove associated content from active systems, subject to legitimate backup, legal, security, and operational requirements.
5. Content Standards
Content shared through 日寫 must comply with our Community Guidelines. We prohibit, among other things:
- Sexually explicit content prohibited under our Community Guidelines;
- Sexual exploitation and abuse;
- Sexual content involving minors;
- Harassment and credible threats;
- Serious privacy violations;
- Content facilitating serious criminal harm;
- Spam, scams, and fraudulent activity;
- Content that unlawfully infringes intellectual property rights.
The Community Guidelines form part of these Terms.
6. Content Moderation
We reserve the right to review, restrict, remove, or refuse content where we reasonably believe it violates these Terms, our Community Guidelines, applicable law, platform requirements, or creates a material safety or security risk. We may use automated systems and human review for moderation. We are not required to monitor every piece of content before it is published and cannot guarantee that all inappropriate content will be identified immediately.
7. Suspension and Termination
We may restrict, suspend, or terminate access to 日寫 where reasonably necessary, including where:
- These Terms or our Community Guidelines are seriously or repeatedly violated;
- An account creates a safety or security risk;
- We are required to do so by law;
- The service is being abused, manipulated, or used fraudulently.
Where appropriate, we may provide warnings or opportunities to appeal before or after enforcement. You may stop using 日寫 or delete your account at any time.
8. Purchases and Premium Features
日寫 may offer optional paid features or purchases. Prices and included features will be displayed before purchase. Transactions made through an app marketplace may also be subject to that marketplace's payment, refund, and subscription rules. Except where required by applicable law or the applicable marketplace's policies, purchases may be non-refundable. We may add, modify, or discontinue features over time, but we will not intentionally remove an already-purchased entitlement without an appropriate reason or remedy.
9. Intellectual Property
日寫 itself—including its software, interface, branding, original prompts, graphics, and other materials provided by us—is protected by applicable intellectual property laws. These Terms do not grant you ownership of 日寫 or our intellectual property. You may not copy, sell, redistribute, reverse engineer, or commercially exploit substantial portions of our service except where expressly permitted by us or applicable law.
10. Copyright Complaints
If you believe content on 日寫 infringes your copyright or other intellectual property rights, please contact us with sufficient information for us to identify and review the material. We may remove infringing material and take action against accounts that repeatedly violate intellectual property rights.
11. Availability and Changes
We hope 日寫 will always be available, but we cannot guarantee uninterrupted or error-free operation. We may modify, update, suspend, or discontinue parts of the service for technical, security, legal, or operational reasons. Where a change materially affects users, we will make reasonable efforts to provide appropriate notice.
12. Disclaimer
To the extent permitted by law, 日寫 is provided on an “as is” and “as available” basis. We do not guarantee that the service will always be uninterrupted, error-free, secure, or suitable for every purpose. Nothing in these Terms excludes rights or protections that cannot legally be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of, or inability to use, 日寫. Nothing in these Terms limits liability where doing so would be prohibited by applicable law.
14. Changes to These Terms
We may update these Terms as 日寫 evolves or when legal, technical, or operational requirements change. For material changes, we will provide reasonable notice where appropriate. Continued use of 日寫 after updated Terms take effect constitutes acceptance of the revised Terms where permitted by law.
15. Governing Law
These Terms are governed by the laws of the jurisdiction where Wai Lok Ching, the developer of 日寫, resides, subject to any mandatory consumer protections or other rights that apply in your country or region.
